These Terms of Service ("Terms") govern your access to and use of the Nomo mobile application, website, services, features, content, and related technologies (collectively, the "Service"). The Service is operated by Nomo Co Pty Ltd ABN 96 697 722 053 ("Nomo", "we", "us", or "our"). By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.
Nomo is a digital record-keeping, organisation and educational platform designed to help users store receipts and records; track expenses; track work-related travel; record work-from-home activity; organise financial information; review publicly available tax-related educational content; and generate reports and summaries based on user-provided information. Nomo is not a registered tax agent, a registered BAS agent, an accounting firm, a law firm, or a financial adviser. Nomo does not prepare, lodge, or submit tax returns on behalf of users.
You must be at least 18 years old to use the Service. By using the Service, you represent that you are legally capable of entering into binding contracts, the information you provide is accurate, and you will comply with these Terms and all applicable laws.
You must create an account to access certain features. You are responsible for maintaining the confidentiality of your account credentials, all activity under your account, and notifying us immediately of any unauthorised use. We may suspend or terminate accounts that contain false information, violate these Terms, or are used fraudulently or unlawfully.
Certain features may require a paid subscription. Subscription fees are displayed before purchase. By subscribing, you authorise us and our payment providers to charge applicable fees. Subscriptions automatically renew unless cancelled before the renewal date. You may cancel at any time through your account settings or applicable app marketplace. Unless required by law, fees already paid are non-refundable. Nothing in these Terms limits rights you may have under Australian Consumer Law.
Nomo provides record-keeping tools and educational information only. All information presented through the Service is general information and does not take into account your personal circumstances. Information generated by Nomo is not tax advice, accounting advice, or financial advice, and should not be relied upon as professional advice. Users remain solely responsible for determining whether an expense is deductible, ensuring compliance with ATO requirements, maintaining supporting records, and obtaining professional advice where necessary. ATO guidance and legislation may change at any time. Where any information displayed by Nomo differs from ATO guidance or applicable law, the ATO guidance and applicable law prevail.
Nomo may display ATO publications, tax-related educational content, deduction categories, examples, calculators, summaries, and explanations of common tax concepts. This content is provided for educational purposes only and does not constitute personalised tax advice. Examples provided within the Service are illustrative only and may not apply to your circumstances.
Nomo may use artificial intelligence, machine learning and OCR technologies to extract information from receipts, categorise expenses, generate summaries, identify potentially relevant record categories, and improve user workflows. AI-generated outputs may contain errors, inaccuracies, omissions or misclassifications. You acknowledge that AI outputs are generated automatically, may not always be accurate, and you must independently verify information before relying on it. Nomo does not use AI to provide personalised tax advice and does not determine legal entitlement to deductions.
Receipt scanning is provided as a convenience feature. Users remain responsible for reviewing extracted data, correcting inaccuracies, and retaining original records where required. Nomo does not guarantee that receipt extraction will be accurate or complete.
The Service may integrate with third-party providers, including Open Banking providers, payment providers and other financial data services. Where you choose to connect financial accounts, you authorise the relevant provider to share information with Nomo, your use may be subject to additional third-party terms, and Nomo is not responsible for third-party systems or services. Third-party providers may experience outages, interruptions or delays beyond our control.
You retain ownership of content you upload, including receipts, documents, notes, transaction records and images. You grant Nomo a non-exclusive licence to use, process, store and display such content solely for operating and improving the Service. You warrant that you own or have rights to the content, the content does not infringe third-party rights, and the content is lawful.
You must not use the Service unlawfully, attempt to gain unauthorised access, interfere with security measures, upload malicious code, reverse engineer the Service, use automated tools to scrape data, or misuse the Service in a manner that harms other users. We may suspend or terminate accounts for breaches of this section.
All intellectual property rights in the Service remain owned by Nomo or its licensors. Except as expressly permitted, you must not copy, reproduce, distribute, modify, commercialise, or create derivative works from the Service. Nothing in these Terms transfers ownership of Nomo intellectual property to users.
Users may export their records while their account remains active. If you delete your account, access to the Service will cease, data may be deleted or anonymised in accordance with our Privacy Policy, and certain information may be retained where required by law. Users are responsible for retaining copies of records they may require in the future.
We aim to provide a reliable Service but do not guarantee uninterrupted availability. The Service may occasionally be unavailable due to maintenance, upgrades, technical failures, third-party outages, or circumstances beyond our control. We may modify, suspend or discontinue features at any time.
To the maximum extent permitted by law, Nomo excludes liability for tax assessments, audits, penalties, interest charges, rejected deductions, lost deductions, business interruption, loss of profits, and indirect or consequential losses. To the extent liability cannot be excluded, our liability is limited to resupplying the relevant services or paying the cost of having the services supplied again, at our election. Nothing in these Terms excludes rights that cannot lawfully be excluded under Australian Consumer Law.
You indemnify Nomo against claims, losses, damages, liabilities and expenses arising from your breach of these Terms, your misuse of the Service, your violation of applicable laws, or content uploaded by you.
We may suspend or terminate your access immediately if you breach these Terms, your use presents security risks, or we reasonably suspect unlawful conduct. You may stop using the Service at any time. Termination does not affect rights or obligations accrued before termination.
Your use of the Service is subject to our Privacy Policy. By using the Service, you consent to the collection, use and disclosure of information described in the Privacy Policy.
We may update these Terms from time to time. Where changes are material, we will provide notice through email, in-app notifications, or website publication. Continued use after the effective date constitutes acceptance of the updated Terms.
These Terms are governed by the laws of Victoria, Australia. You submit to the exclusive jurisdiction of the courts of Victoria and any courts entitled to hear appeals from those courts.
